To provide information to West Los Angeles pet owners and other interested persons concerning the largest reported result in a veterinary malpractice case for the loss of a pet in U.S. history.

 

Description of Lawsuit

The lawsuit (Pomerantz v. Schwartz, et al., Los Angeles Superior Court Case No. SC 119009) alleged malpractice, violation of California's anti-cruelty laws, fraud, fraudulent non-disclosure and unfair business practices against two West Los Angeles veterinarian clinics:

1.  Overland Veterinary Clinic (Trey "Louis" Schwartz, DVM) and

2.  California Animal Rehabilitation, Inc. ("CARE")

Outcome of Lawsuit

The total settlement of $114,000 is the largest reported result in a veterinary malpractice case for the loss of a pet in U.S. history.

Dr. Schwartz agreed to accept a judgment against himself for $75,0000 rather than attempt to defend his case at trial.  CARE agreed to pay $39,000 to avoid trial.
